بيع الغَرَر: هو البيع الذي فيه خطر انفساخه بهلاك المبيع، والغرر- محركة-: التعريضُ للهلكة وما طوي عنك علمُه، وفي "المبسوط": "الغرر ما كان مستورَ العاقبة". وفي "المغرب": "الغرر" هو الخطر الذي لا يدري أيكون أم لا". قال النووي: "النهيُ عن بيع الغرر أصلٌ عظيمٌ من أصول كتاب البيوع، ويدخل فيه مسائلُ كثيرةٌ، كبيع الآبق، والمعدوم، والمجهول، وما لا يقدر على تسليمه، وما لم يتم ملك البائع عليه، وبيعُ السمك في الماء الكثير، واللبن في الضرع، وبيعُ الحمل في البطن، وبيعُ بعض الصبرة منها، وبيعُ ثوبٍ من الأثواب، وشاة من شياه، ونظائر ذلك، فكل هذا بيعه باطل لأنه، غررٌ من غير حاجة".
